General Conditions of Use of Budding Projects

Introduction

By becoming a member of Budding Projects, you agree to comply with the present conditions of use. If you do not accept these general conditions of use, you must not register with Budding Projects. Subscription to one or several services together with the use of the present site implies full and complete acceptance by the member of the present conditions.

Article 1 - Joining Budding Projects

To be a member of Budding Projects, you must be an adult and fill in all the mandatory fields on the registration forms.

Equipment (computer, software, means of telecommunication, etc.) used to access Budding Projects services are under your exclusive responsibility, as are the telecommunication costs incurred by their use.

You guarantee that the data you share with us is accurate and true. You agree to provide a real email address, of which you are the actual owner. You waive any claim and/or legal action against Budding Projects if you do not to receive service messages from Budding Projects sent by email to the address you have provided.

Once registered, you will be given one or several personal and confidential login(s) and password(s). These must not be communicated to or shared with third parties. In no case will Budding Projects be held responsible for the loss of your usernames and/or passwords.

In the event that you misuse the login and authentication logins/passwords, Budding Projects reserves the right to terminate your account without prior notice. You will be solely liable for the use of the login and authentication logins/passwords by third parties or for actions or statements made through your account, whether fraudulent or not. You hereby agree indemnify Budding Projects against any claim, fine or damages resulting from such misuse.

Budding Projects does not have the means to check the identity of people registering for its services. Budding Projects will not be held responsible for any alleged or actual identity theft. If you think that someone is using your account or your identity, you must inform us immediately by email at reclamations@buddingprojects.com.

When a member wishing to invite a contact provides Budding Projects with their email address, he warrants having received this friend's prior consent (actual or implied) authorizing their data to be used by Budding Projects. It is solely responsible for the consequences of the transmission to Budding Projects of the coordinates of their contact(s).

Budding Projects reserves the right to deactivate the accounts of members who have not connected to the service for a period of 6 (six) months or more.

Article 2 - Use of Budding Projects

Once registered, you will be granted access to Budding Projects's services.

By using Budding Projects, you specifically agree to observe the following rules:

• To comply with the applicable laws in force and to respect the rights of third parties as well as the present provisions.
• To deal in good faith with Budding Projects and other users.
• To respect the intellectual property of Budding Projects, other users and third parties.
• To use Budding Projects features only for their intended purpose.
• Not to overload the Budding Projects service.
• Not to send Budding Projects or other users any data your private information which if disclosed could be prejudicial to you.
• Not to distribute data or contents that are untrue or misleading.
• Not to distribute or post any data or contents that may harm other users or third parties, or violate the rights of others, including but not limited to any content of a defamatory, insulting, obscene, offensive, violent nature or capable of inciting others to violence, nor content of a political, racist or xenophobic nature, or any other content that is contrary to the purpose of Budding Projects, or any applicable laws and regulations.
• Not to distribute data or contents the effect of which is to diminish, disorganize, prevent the normal use of Budding Projects, disrupting and/or slowing down the normal circulation of communications between members.

In case of infringement by a member of one or more of these rules, Budding Projects reserves the right to block the account(s) of the members in question, to automatically delete litigious messages, to prevent the posting of all or part of a member's profile, and/or to block their access to all or part of the services, on a temporary or permanent basis, without any compensation.

Budding Projects shall not be held responsible for any false or misleading statements made by a member. Budding Projects disclaims all responsibility related to any communications between Budding Projects members, on Budding Projects or during meetings between members and/or non members, as a result of the use of its site and services.

Article 3 - Data Confidentiality

The Budding Projects site respects your right to privacy and was the object of a declaration registered with the French authorities for the protection of personal data (Commission Nationale de l'Informatique et des Libertés - National Commission for Information Technology and Civil Liberties - CNIL) under number 1406513.

Users may make certain information or contents (including but not limited to photos and videos) available on the website. The member is wholly responsible for all such information and contents, including any decision to disclose personal information including but not limited their ethnic origin, nationality and/or religion. By providing such data on the website, the user concerned demonstrates their explicit wish and, consequently, consent to the processing of this 'sensitive' data by Budding Projects and freely accepts exclusive responsibility for doing so.

The data that may be stored on Budding Projects is exclusively intended to help you find offers and recruit talented people according to your needs.

You have a right of access, rectification and deletion of your data (art. 34 of the French law on Information Technology, files and civil liberties). You can exercise this right by writing to the customer service department by email at reclamations@buddingprojects.com.

We use the information you provide for our various services. All precautions have been taken to store your data in a secure environment. None of the information you enter and that relates to you will ever be communicated to a third party, neither sold nor exchanged.

You may change or delete at any time all your information by directly accessing the Budding Projects Web site, at the following address: www.buddingprojects.com.

Due to the nature of a website, some non-personal data may be collected such as the version of your browser (Firefox, Internet Explorer, etc...), of your operating system (Windows, Mac, Linux, etc...) and your IP address.

Budding Projects uses cookies when you visit our site, so that you do not have to enter the same information every time you access a page. You may deactivate the use of cookies by changing your preferences in your Internet browser. In this case, certain Budding Projects features may no longer be available.

Your profile information is accessible on Budding Projects. You therefore expressly authorize Budding Projects to reproduce and distribute your data throughout all or part of Budding Projects or via email. If you do not want Budding Projects to reproduce or distribute this data, you may terminate your Budding Projects account according to the conditions set forth in the Termination article below. You may also delete this information directly on the site.

Article 4 - Terminating your Account

Follow the five steps to delete your Budding Projects account at any time without having to provide any notice.

2. Click 'Settings' at the top right of the page.
3. Select 'Privacy'
4. Click on 'delete your Budding Projects account'
5. Click on 'I really want to delete my account'

The deletion of you account and of your personnel details will be effective within 24 hours.

Your data will not be passed to third parties.

In the event of a breach on your part of the present terms of use, Budding Projects reserves the right to suspend or terminate your account without notification or compensation.

This termination shall occur without prejudice to all damages and interests that may be claimed against you by Budding Projects or its assignees and legal representatives as remedy for any damages incurred as a result of such failures.

Article 5 - Liability

The information provided by a member must be accurate and true. The consequences of its disclosure on your life and/or on that of other members are your exclusive responsibility. You waive the right to any legal action against Budding Projects, and specifically on the basis of potential damage to your right of personal portrayal, to your honour, to the intimacy of your private life, resulting from the distribution or disclosure of any of your information.

Budding Projects cannot be held liable for the accuracy or inaccuracy of information and content provided by other members, visitors to the site and/or yourself. Likewise, Budding Projects cannot be held responsible for content distributed by a member that may infringe the rights of one or several other members.

The quality of the www.buddingprojects.com site required by both Budding Projects and its members implies compliance with a certain code of ethics in the expression and behavior of its members, the respect for the rights of third parties, as well as the respect of the laws and regulations in force. In order to meet the requirements of quality, individual and ethical responsibility, each member may notify Budding Projects on the www.buddingprojects.com site of any data (picture, text), behavior or words of another member which they believe infringe on laws and regulations in force, or harm the image or purpose of Budding Projects, the rights of third parties or morality. Consequently, members acknowledge and accept that the data they provide, as well as their behavior or their words are subject to notification by other members and to review and/or verification by Budding Projects, on the basis of objective criteria of evaluation. In the event that this notification or verification reveal the violation by a member of any laws or regulations in effect or of the member's contractual obligations, the provisions of the current Terms of Use, and specifically Article 5 - "Terminating your account" may be enforced.

In the event that the responsibility of Budding Projects is alleged due to failure by a member to meet their obligations under the terms of the law or under the current terms of use, the aforementioned member promises not to hold Budding Projects responsible for any judgment against their, this guarantee covering both fines that might be paid as well as attorney's fees and legal costs the member may have to pay.

Article 6 - Budding Projects' operation

You must possess the skills, hardware and software required for Internet use and acknowledge that the features and limitations of the Internet do not make it possible to guarantee the security, availability and integrity of Internet data transmissions.

Budding Projects does not guarantee that the services will function without any interruption or error. Specifically, their operation may be momentarily interrupted for reasons of maintenance, update or technical improvement, or for the upgrade their content and/or presentation.

You waive the right to hold Budding Projects responsible for the operation and exploitation of the www.buddingprojects.com site.

Likewise, Budding Projects will not be held responsible in the event of failure, access denial, or poor conditions of use of the Budding Projects site due to inadequate equipment, to interruptions attributable to the member's access provider, to Internet network congestion, and/or any other reason out of Budding Projects's control.

Budding Projects shall have no liability in whole or in part for indirect losses including, but not limited to, loss of data (including copies) or back-ups that you could have made.

Article 7 - Modifications by Budding Projects

Budding Projects reserves the right at any time to change or modify the pages of its website, the services, prices and/or conditions of use applicable thereto.

These modifications shall become effective as soon as they are put online on the www.buddingprojects.com site and will not constitute a cause for termination by a member of their Budding Projects subscription.

Failing that, you shall be deemed to have accepted these modifications by continuing to use the www.buddingprojects.com site. Members are therefore invited to view the most recent online version on the site. A member's presence on the site implies their full acceptance of any revision or modification of the www.buddingprojects.com site.

Article 8 - Applicable law - choice of jurisdiction

These terms and conditions are governed, interpreted and applied according to French law, and the version in the French language will be used in the case of any dispute or claim arising from the meaning of any term or these terms and conditions of sale and use.
